On Tuesday, Heather Baker finished her witness duties. The next witness was Desire2Learn's chief operating officer Jeremy Auger, followed by resource manager Dana Frigula and director of marketing John McLeod. After John testified, Tom Britven, our expert on damages testified. Dr. Fred Hofstetter, of the University of Delaware and creator of the Serf system, testified next, followed by brief testimony by Dr. Dick Simmons, our technical expert.
Dr. Simmons continued his testimony on Wednesday, followed by brief questioning of Michael Chasen. We wrapped up our case with the testimony of our president & chief executive officer John Baker. Blackboard brought back Dr. Jones, its technical expert, as its sole rebuttal witness.
The lawyers, and the Court, worked late into the night on Wednesday night hammering out jury instructions. Yesterday, the judge read the lengthy instructions to the jury, and they were dismissed to deliberate. No decision was reached, and they were going to reconvene this morning.
In the meantime, Desire2Learn is putting on its inequitable conduct case against Blackboard before the Court, and outside the presence of the jury. In its case, Desire2Learn called Dan Cane, Timothy Chi, Bob Alcorn, Dr. Fred Hoffstetter, and Matthew Pittinsky, and by transcript of deposition Anthony Barkume and Lisa Sotir Ozkan. The inequitable conduct case will continue on Friday.
